AI on WhatsApp Business: what Meta allows and what it costs in 2026

Meta's clause on AI providers read in full, the exception the European Commission imposed for France and the rest of the EEA, the rates that took effect on 1 October 2026, and what Meta charges per month for an AI agent handling 500, 2,000 and 10,000 conversations. Checked on 29 October 2026.

For EEA users, and for now, Meta has not charged AI assistant providers since 13 May 2026. Since 1 October, other businesses pay for their replies beyond 1,000 a month.

In short

The short answer

A business in France can connect a support, sales or booking AI agent to WhatsApp Business. Meta's "AI Providers" clause targets companies whose AI is the product itself, and those are allowed again for EEA numbers while the EU interim measures last. Since 1 October 2026, every reply beyond 1,000 per month per number costs €0.0248 to a French number.

The text

What the "AI Providers" clause actually says

Article 4.7 of Meta's WhatsApp Business Platform terms bans AI providers (large language models, generative AI platforms, general-purpose assistants) from the platform when AI is the primary functionality they offer. AI that is incidental to your business stays allowed. Meta alone decides which side of the line a use falls on.

In the 23 September 2026 version of the "Meta Terms for WhatsApp Business Platform", providers and developers of AI technologies, "including but not limited to large language models, generative artificial intelligence platforms, general-purpose artificial intelligence assistants", are "strictly prohibited" from using the platform to offer those technologies "when such technologies are the primary (rather than incidental or ancillary) functionality being made available for use, as determined by Meta in its sole discretion".

Read plainly, the clause sorts uses by one question: is the AI what the customer came for, or a way to serve them something else? A conversational assistant sold for its own sake falls in the first group. A shop's bot answering order questions, a practice booking appointments or an estate agency qualifying a buyer falls in the second.

The same clause holds a rule that the three top-ranking pages we read on 29 October 2026 do not mention. A business may hire an AI provider as its technical provider, but it must not let WhatsApp Business Platform data be used to create, train or improve any AI model, in any form, including anonymous or aggregated data. The only exception is fine-tuning a model for your exclusive use. In practice, your contract with the model provider has to exclude training on your conversations. Our guide to GDPR and the OpenAI, Anthropic and Mistral DPAs compares what each contract says on that point.

The uncomfortable part is "sole discretion". Meta publishes no list of examples and no appeal process. An agent whose conversations drift to general requests, such as drafting a letter or summarising an article, takes a risk nobody can price. The defence is technical: keep the agent on your business topics and have it decline the rest.

In France, general-purpose assistants are allowed again, for now

Meta's "AI Providers" page, updated 15 October 2026, lists France among the markets where AI providers may send service messages since 11 March 2026, and where Meta stopped charging them on 13 May 2026. The European Commission ordered that free access on 9 June 2026, until its final decision.
Timeline of six dates: 15 October 2025, Meta bans general-purpose AI assistants according to the Commission; 15 January 2026, AI Providers clause in force according to Meta's AI Providers page; 11 March 2026 according to Meta, 4 March according to the Commission, EEA allowed again for a fee; 13 May 2026, EEA fee dropped; 9 June 2026, the Commission orders free access; 1 October 2026, service and in-window utility messages charged with 1,000 free service messages
Lumyniq diagram. Sources: Meta terms (23 September 2026), Meta's AI Providers page (15 October 2026), European Commission press release IP/26/1276 (9 June 2026).

The Commission's press release of 9 June 2026 gives the sequence. On 15 October 2025 Meta banned third-party general-purpose AI assistants from the WhatsApp Business API, leaving Meta AI alone on the app. The Commission opened an investigation in December 2025, sent a Statement of Objections in February 2026 and a supplementary one in April. On 4 March 2026, according to the Commission, Meta let those assistants back in for a fee that it considers equivalent in practice to the ban.

The 9 June decision orders Meta to restore access on the terms in place before 15 October 2025, which were free of charge, within five working days, and to keep them until the final decision. The Commission states that the investigation on the merits continues. It presents the decision as the second interim measures decision under Regulation 1/2003, after the one concerning Broadcom, dated 16 October 2019 by press release IP/19/6109.

Screenshot of Meta for Developers, New pricing policy for AI Providers, taken on 29 October 2026.

Meta's page gives slightly different dates: access in the EEA from 11 March 2026, charged until 12 May, free from 13 May 2026, nearly a month before the Commission's decision. Italy is listed separately, from 16 February 2026. Brazil is still charged, and Türkiye has been free since 15 October 2026. Meta does not explain the gap with the Commission's dates. Meta's page does not say whether the free allowance and the 1 October service rate apply to AI providers sending to the EEA.

What this changes for a business in France depends on what it does. For a support or sales agent, nothing: it was already allowed. For a company selling a conversational assistant as its product, access is open to EEA numbers and only to them, because the rule follows the recipient's country code. A customer in Switzerland (+41) or Morocco (+212) is outside the exception. The opening lasts until the Commission's final decision.

Allowed or not: the cases a business in France meets

For a small business the "AI Providers" clause rarely gets in the way. The rules that matter sit in WhatsApp's messaging policy: no first message without the customer's opt-in and an approved template, a route to a human at all times, and no request for full card or ID numbers in the chat.

The policy words the escalation rule this way: a business may use automation when replying in the 24-hour window, but must also have "prompt, clear, and direct escalation paths". Meta's list: in-chat transfer to a human, a phone number, email, web support, an in-store visit or a support form. An agent that loops without ever offering one of these breaks the rule.

These rules apply to the WhatsApp Business Platform, the API an AI agent connected to your tools uses. The free WhatsApp Business app on a phone has its own features and is outside this pricing.

What Meta charges since 1 October 2026

Meta charges for every message the business delivers, by category and by the recipient's country code. Since 1 October 2026, free-form service replies are paid again beyond 1,000 per month per number, and utility templates sent inside an open conversation are charged. To a French number, both cost €0.0248.

The 1,000 allowance counts messages, and it applies per phone number. Unused messages do not carry over. Meta also warns that an account without a payment method gets its service messages delivered up to the allowance, then blocked. A guide that still ranks for "whatsapp chatbot", last modified in July 2026, says service replies are not charged: that was true from 1 November 2024 to 30 September 2026, according to Meta's pricing page.

Three mechanics complete the rate card. The 24-hour window opens with each customer message and only the customer can reopen it; outside it, the business can only send templates. A conversation started from a click-to-WhatsApp ad, on the Android or iOS app, opens a free entry point window of up to 7 days in which Meta charges for no service, utility, marketing or authentication message. And Meta only changes rates on 1 January, 1 April, 1 July or 1 October, with one month's notice for a rate card update.

The measurement

What 500, 2,000 and 10,000 conversations cost per month

For a support agent sending four messages per conversation on one French number, Meta charges €24.80 a month for 500 conversations, €173.60 for 2,000 and €967.20 for 10,000. A booking agent that adds a confirmation and a reminder costs €49.60, €272.80 and €1,463.20. The AI model is billed on top.

Lumyniq diagram, calculated on Meta's France rates in euros read on 29 October 2026. Excludes the AI model and provider fees.

The method, so you can rerun it with your own numbers:

  1. Conversation assumption. Four messages sent by the business: greeting, two answers, closing. Customer messages are free and left out.
  2. Scope. One phone number, a euro-billed account, recipients on +33, no conversation coming from an ad (so no free entry point window).
  3. Scenario A, support. Billable messages = 4 × conversations − 1,000. Cost = that number × €0.0248.
  4. Scenario B, booking. A, plus two utility templates per conversation: the confirmation sent during the chat (charged since 1 October) and the reminder the day before (always charged). Extra = 2 × conversations × €0.0248.
  5. Meta Business Agent. Four messages × $0.04 to $0.05, Meta's estimate for 20,000 to 25,000 tokens per message. No free allowance.

Lumyniq calculation, 29 October 2026, on Meta's France rates (service and utility €0.0248). Before 1 October 2026 only the reminder sent outside the conversation was charged, at the 29 October 2026 rate.

The result depends mostly on messages sent per conversation. Same calculation, scenario A:

Messages sent per conversation500 conversations2,000 conversations10,000 conversations
2€0€74.40€471.20
4€24.80€173.60€967.20
6€49.60€272.80€1,463.20
Lumyniq calculation, Meta France service rate on 29 October 2026, one number, 1,000 free messages deducted.

Three readings. First, below 250 four-message conversations, the free allowance covers the whole service bill; above that, it saves €24.80 a month, and the bill grows by €0.0992 per conversation. Second, an agent that splits its answer into three short messages pays three times, so putting the information in one message costs less. Third, the same support agent cost nothing in Meta fees until 30 September 2026.

Meta publishes its own comparison on its pricing page updated 30 September 2026, for 10,000 messages in Brazil: about $0.04 to $0.05 per message with Meta Business Agent, against $0.09 to $0.10 for a third-party agent. The third-party figure is Meta's own estimate. In France, a third-party agent pays €0.0248 per message above the allowance, plus its model; without a currency conversion the two amounts are not directly comparable. The total depends on the model and the length of the exchanges, and has to be worked out on your own volume.

Meta's own offer

Meta Business Agent and Meta AI: what is available in France

Meta Business Agent is the AI agent Meta offers businesses on their own WhatsApp number, available globally according to TechCrunch (3 June 2026). Meta's documentation requires an "authorized" country without publishing the list, and excludes several sectors including health and finance. As of 29 October 2026, its availability in France could not be confirmed.

According to Meta's documentation, the agent answers from the business's information, FAQs, websites and files, can call the business's APIs to book or confirm a payment, and hands control back to the business's app when needed. TechCrunch reports that it answers questions, recommends products, books appointments, qualifies leads and hands off to a human, and that Meta plans to include it in some tiers of its WhatsApp Business Premium subscription.

The eligibility conditions Meta publishes:

  • a supported vertical: all except finance, government, health, alcohol, gambling, over-the-counter drugs and matrimony services;
  • a WhatsApp Business Platform account, the free app is not enough;
  • an account in good standing, a verified business, based in an authorized country;
  • no other AI agent already active on that number.

Meta names its eligibility API as the authoritative check. One detail matters if you already run an agent: enabling Meta Business Agent makes it the primary responder for new conversations, and other integrations move to standby. For a medical practice or a broker the question is settled in advance, because those sectors are excluded.

Meta AI is a different product. It is Meta's assistant for WhatsApp users, rolled out in 41 European countries from March 2025 according to Meta's announcement of 19 March 2025. A business does not configure it and does not use it to answer its customers. A search for "meta ai whatsapp" mostly targets that consumer assistant, based on our reading of the results on 29 October 2026.

Compliance

GDPR and the CNIL: what applies to the business

The business remains the controller of its WhatsApp conversations. Meta acts as processor for the platform (article 1.4 of its terms) and as controller for the safety of the service (article 7.7). Marketing messages follow the consent rules restated by France's data protection authority, the CNIL, and an AI agent has to say it is one.

Roles. For a European customer the contract is with Meta Platforms Ireland Limited (article 1.2). Article 1.4 points to Meta's processor terms where Meta processes data on your behalf. Article 7.7 adds that Meta may use personal data as a controller for the safety and integrity of the platform. The AI model provider is a second processor, with its own contract.

Storage. By default Cloud API stores messages in the United States. Meta offers local storage, including an "EU (Germany)" option, set number by number and only before the number is registered. Even when it is enabled, content may sit in data centers outside the chosen region for up to 60 minutes while in use, according to Meta's documentation updated on 21 May 2026.

Marketing. The CNIL's practical sheet of 10 June 2026 separates marketing, transactional and relationship messages. It covers email, SMS, MMS, automated calls "and other technologies" without naming WhatsApp; we read a messaging app as one of those other technologies. Marketing rests in principle on prior consent, with an exception for existing customers and similar products, and a right to object at collection and in every message. Meta separately requires opt-in before any first message.

Transparency. Since 2 August 2026, article 50 of the AI Act requires telling people they are dealing with an AI. We cover wording and exceptions in the AI agent disclosure duty.

Health. WhatsApp's policy bans exchanging health information where regulations require a hardened system. In France, patient health data hosted for a healthcare professional falls under certified HDS hosting, so WhatsApp is the wrong channel for those exchanges.

Limits

What this calculation leaves out, and when not to use WhatsApp

The calculation covers Meta's bill only. It leaves out the AI model, any fees from the technical provider and the time spent getting message templates approved. The part on general-purpose assistants rests on a temporary European rule, and the calculation on rates Meta can revise every quarter.

Fees left out. A Meta-approved Solution Provider can add its own subscription or a per-message margin: read its rate card before our calculation. The AI model is paid by the token, depending on the provider and the context length.

The temporary rule. Free access for general-purpose assistants in Europe rests on interim measures. A company building a product on that exception depends on where the investigation goes.

When not to use WhatsApp. If your customers do not message you on WhatsApp, opening the channel will not create demand. If you handle health data, it is ruled out. If your customers call, voice AI meets a different need: see our guide to the AI phone receptionist for small businesses. Below 250 four-message conversations a month, the free allowance covers Meta's whole service bill; the AI model, any utility templates and the agent's setup remain.

Decision

Custom agent, platform or Meta Business Agent: how to choose

There are three routes: Meta's agent, billed by the token, unconfirmed in France and closed to several sectors; a chatbot platform with a WhatsApp connector; or a custom agent connected to your tools. The right one depends on what the agent must do after it answers: book, update a CRM, apply your business rules.

Lumyniq grid, 29 October 2026. For platforms, see our review of AI chatbots.

Lumyniq, a French AI automation agency, builds custom AI agents for WhatsApp and other channels: support, qualification or booking agents connected to the company's tools, with the route to a human and the disclosures the AI Act requires. It is an agency project, with setup time and a project budget, and there is no self-service version.

Lumyniq is also preparing Agent Studio, which sets up an AI agent from your website's pages and puts it on WhatsApp, Telegram, Messenger, email and your site. It is not available yet: the waitlist is open.

FAQ

Common questions about AI on WhatsApp Business

A business can run a model from OpenAI, Anthropic or Mistral behind its support or sales agent in any market, because the AI is incidental to its business, which article 4.7 of Meta's terms allows. Offering a general-purpose assistant as the product itself is allowed for users in the EEA, France included, while the interim measures imposed by the European Commission on 9 June 2026 remain in force.
